TERMS & CONDITIONS

1. Agreement

These Terms & Conditions (“Agreement”) govern all services provided by TWENTY FOUR NORTH MEDIA GROUP LLC dba TWENTY FOUR NORTH MEDIA (“TWENTY FOUR NORTH MEDIA”) for all current and future projects unless otherwise agreed to in writing. By scheduling services with TWENTY FOUR NORTH MEDIA, the Client agrees to all terms outlined herein. TWENTY FOUR NORTH MEDIA reserves the right to modify or update these Terms & Conditions at any time without prior notice. The most current version shall govern all future engagements.

2. Services & Deliverables

TWENTY FOUR NORTH MEDIA provides professional photography, videography, drone, floor plan, virtual staging, marketing, and related media services designed to present properties in their best light.

Media deliverables are based on the size, condition, features, layout, and complexity of the property or project. Final media is generally delivered within twenty-four (24) to forty-eight (48) hours following completion of the appointment unless otherwise specified.

Media is delivered electronically through a Client Access link via [24NorthMedia.com](https://www.24northmedia.com?utm_source=chatgpt.com) and includes both:

  • Web Resolution (MLS/Social Media)

  • High Resolution (Print/Marketing)

For projects priced by square footage, TWENTY FOUR NORTH MEDIA reserves the right to adjust pricing if incorrect square footage information was provided at the time of booking.

3. Licensing – Short-Term Rental, Commercial & Multifamily Projects

Short-term rental, hospitality, builder, developer, commercial, and multifamily projects require expanded licensing and usage rights.

Unless otherwise agreed to in writing:

  • Short-term rental licensing is valid for two (2) years from delivery date.

  • Commercial and multifamily projects are subject to one-time licensing fees.

  • Additional licensing, renewal, advertising, publication, resale, syndication, or extended usage rights may require additional fees.

Copyright ownership remains exclusively with TWENTY FOUR NORTH MEDIA.

4. Scheduling & Booking

Appointments may be scheduled by phone, email, online booking, or other approved communication methods. A booking is considered confirmed once both parties acknowledge and agree upon the appointment date and time. Next-day or rush appointments are subject to availability and may incur additional fees.

TWENTY FOUR NORTH MEDIA reserves the right to refuse or reschedule services due to unsafe conditions, property condition, weather, accessibility issues, or other unforeseen circumstances.

5. Property Preparation & Shoot Conditions

The Client is responsible for ensuring the property is properly cleaned, staged, prepared, and photo-ready prior to the scheduled appointment. All properties are photographed and/or filmed “As Is.” TWENTY FOUR NORTH MEDIA may make reasonable minor adjustments to improve presentation; however, services do not include deep cleaning, extensive staging, furniture moving, landscaping, repairs, decluttering, or property preparation unless specifically agreed to in writing.

The Client is strongly encouraged to have an authorized representative present during the appointment to approve TWENTY FOUR NORTH MEDIA’s interpretation of the project, shot selection, and creative direction.

If no representative is present, the Client agrees that TWENTY FOUR NORTH MEDIA shall use professional judgment and discretion regarding composition, angles, room selection, lighting, and media capture.

6. Delivery

Following the appointment, TWENTY FOUR NORTH MEDIA will perform editing, retouching, processing, and media preparation before delivery. Delivery timelines are estimates and may vary based on project size, weather, revision requests, technical issues, holidays, or workload volume. TWENTY FOUR NORTH MEDIA is not responsible for delays caused by internet outages, software issues, third-party platforms, acts of nature, or circumstances beyond reasonable control.

7. Cancellation, Rescheduling & No-Show Policy

Appointments cancelled or rescheduled within twenty-four (24) hours of the scheduled appointment time are subject to a cancellation fee equal to fifty percent (50%) of all scheduled services. Failure of the Client, homeowner, tenant, or authorized representative to provide property access at the scheduled time may result in full billing of the appointment. If TWENTY FOUR NORTH MEDIA arrives at the property and cannot complete services due to property condition, access issues, unsafe conditions, unprepared spaces, pets, occupants, utilities being disabled, or excessive delays, the appointment may be cancelled and billed accordingly.

In the event of inclement weather affecting exterior photography, drone operations, twilight photography, or other weather-dependent services, TWENTY FOUR NORTH MEDIA reserves the right to reschedule affected portions of the project.

8. Copyright, Rights & Usage

All media produced by TWENTY FOUR NORTH MEDIA (“Media”) remains the sole property and copyrighted work of TWENTY FOUR NORTH MEDIA. Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the Media solely for the marketing, advertising, and promotion of the specific property and for the Client’s personal or business self-promotion related to real estate services. This license applies only while the property is actively marketed for sale or lease by the Client unless otherwise agreed to in writing by TWENTY FOUR NORTH MEDIA. If applicable, the Client’s parent company, managing brokerage, ownership group, or property management company may use the Media solely for the promotion of the specific property.

The Media may not be sold, transferred, sub-licensed, shared, distributed, edited, repurposed, or otherwise provided to any third party without prior written consent from TWENTY FOUR NORTH MEDIA.

Prohibited third parties include, but are not limited to:

  • Architects

  • Builders

  • Designers

  • Stagers

  • Homeowners

  • Buyers

  • Vendors

  • Publications

  • Marketing companies

  • Artificial Intelligence (AI) systems or platforms

The Media may not be used for:

  • AI training

  • Machine learning

  • Automated editing systems

  • Generative AI

  • Data scraping

  • Automated content-generation systems

without explicit written authorization from TWENTY FOUR NORTH MEDIA. Unauthorized use constitutes copyright infringement and may result in additional licensing fees and/or legal action.

TWENTY FOUR NORTH MEDIA retains the unrestricted right to use all Media for portfolio, promotional, advertising, educational, social media, competition, and marketing purposes.

9. Payment Terms

Invoices are delivered electronically and payment is due within fifteen (15) calendar days of invoice delivery unless otherwise agreed to in writing.

  • ACH/Online Payment

  • Check

TWENTY FOUR NORTH MEDIA reserves the right to withhold delivery, deactivate download access, revoke licensing rights, refuse future bookings, assess late fees, or pursue collections/legal remedies for unpaid balances.

10. Limitation of Liability

TWENTY FOUR NORTH MEDIA shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from services provided. TWENTY FOUR NORTH MEDIA’s total liability for any claim related to services rendered shall not exceed the amount paid by the Client for the specific project giving rise to the claim.

Client assumes responsibility for obtaining any necessary permissions, approvals, HOA permissions, property access authorization, tenant notifications, or legal clearances related to the property being photographed or filmed.

11. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Michigan.

12. Entire Agreement

These Terms & Conditions constitute the complete agreement between the parties and supersede all prior discussions, understandings, or agreements relating to services provided by TWENTY FOUR NORTH MEDIA.

If any provision is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
